2.3 Farmer’s Market Conditions

BOOKING CONDITIONS
1. In these conditions
‘GLC’ means the Guildford Lions Club
‘The Trader’ means the person(s), firm or company booked to participate in the Fayre
‘The Site’ means Shalford Park
‘The Fayre Co-ordinator’ means the member of GLC appointed to supervise the Fayre or his duly appointed representative
‘The Booking Fee’ means the fee of £25 charged by GLC for participation in the Fayre
2. The Booking Fee of £25 must be fully paid in advance and is non refundable. The Booking Fee shall include parking for one vehicle. Additional vehicles will be charged on the day.
3. All vehicles must park in the official car park unless they form part of the display.
4. An entry permit will be sent to you on receipt of the Booking Fee. The permit must be shown on entry to The Site to gain access.
5. Traders shall occupy only the positions (pitch) allocated by the Fayre Co-ordinator. The siting of each pitch is entirely at the discretion of the Fayre Co-ordinator, whose decision is final.
6. GLC reserve the right to refuse admission or ask for any stand or exhibit to be moved or removed at any time. The decision of the Fayre Co-ordinator is final.
7. Stands or displays must be completed and set up ready for business by 9am on the day. Access to the site will be available from 7am.
8. The Traders name or that of the firm, company or organization should be clearly displayed in large lettering on the display or stand.
9. The Traders must not use offer for sale or sell any hazardous materials, which, in the opinion of the Fayre Co-ordinator, may be regarded as hazardous.
10. Gas cylinders, power generators and fuel – all propane and butane gas cylinders, power generators and fuel containers must be fenced and secure from public access and under the security of The Trader. Traders using gas or petrol/diesel powered equipment are required to have an appropriate fire extinguisher on site. Al electrical power cables must be secure from public access and marked with ‘hazardous tape’.
11. Tap water is available on site, but no other services are provided by GLC.
12. Traders shall keep their stands and displays free from litter, other than in proper receptacles. Further, Traders shall make good any damage done to the ground occupied and clear away all materials and refuse before vacating the site. The Trader accepts that all goods, equipment or property of any nature delivered to and/or for use at the site are at the Trader’s own risk and that no liability or responsibility of any kind attaches to, or is accepted by GLC.
13. Traders must not do or prevent anything to be done, which in the opinion of the Fayre Co-ordinator may be a nuisance or annoyance to any member of the public, or which may be detrimental to the Fair.
14. Public Rides and Amusements – Operators of mechanically and/or electrically powered rides or amusements are required to provide copies of current Engineering Tested Certification and Safety certificates no later that 7 (seven) days before the event.
15. Catering Suppliers – All operators providing public catering must provide a current copy of their Public Health Certification no later than 7 (seven) days before the event.
16. The Trader agrees to indemnify GLC against all and any claims or demands (whenever made and howsoever arising) and all costs and expenses incurred by GLC and relating to or arising out of the use of the pitch by the Trader and further against any claims which may at any time be made against GLC (whether under the Occupiers Liability Act 1957 or otherwise) in relation to the pitch (including any claim by any of the Trader’s employees) arising wholly or in part from any act or omission by GLC.
17 The Trader must hold a valid insurance policy for public liability claims (with a limit of liability of at least £1 million and which shall include an “Indemnity of Principals” clause) and agrees, not less than 14 days prior to the Event, to produce evidence of such insurance to GLC or the Fayre Co-ordinator. In the absence of such evidence the Trader may request Public Liability insurance cover by completing the relevant part of the Booking Form and paying the stated premium. GLC reserves the right to refuse either to accept any booking or to provide Public Liability insurance cover. Further GLC may insist that the Trader arranges his own cover and produces evidence of such cover; in such circumstances GLC will refund any premium paid to them with the booking form.
18 Traders shall comply with all directions of the Fayre Co-ordinator which do not conflict with these conditions and all allocations of pitches are made on the express understanding that they may be terminated immediately by the Fayre Co-ordinator in the event of any contravention by a Trader of these conditions.
